PETITION FOR INCORPORATION OF TOWN

 

            Come now the undersigned applicants and show to the Honorable Board of County Commissioners of Grady County that they the undersigned constitute more than one-third of the whole number of qualified voters residing within the area and territory hereinafter described and that under the statutes of the State of Oklahoma, O.S. 1931, Chapter 33, Article 25, your applicants are entitled to file this petition before the Honorable Board and that this Honorable Board has jurisdiction of the matters herein petitioned for.

 

        Applicants allege that they have caused an accurate survey and map to be made of the territory hereinafter described and herein petitioned to be incorporated into and to be embraced within the limits of the Town of Bradley and that such survey was made by a practical surveyor and shows the courses and distances of the boundaries thereof and the quantity of land contained therein and the accuracy of such survey and map has been verified by the affidavit of such surveyor written thereon and annexed thereto as more fully and completely appears from the copy of said survey and map with the verification thereon which is hereto attached marked Exhibit "A: and made a part of this petition.

 

        Applicants allege that one of their number, A. T. Brown, has caused an accurate census to be taken of the resident population of such territory aforesaid as it was on the 19th day of October, 1938, which is a day not more than thirty days previous to the time of presenting this application to this Honorable Board and that said census exhibits the name of every head of a family residing within said territory on such day, and the number of persons then belonging to every such family, and the said census is properly verified by affidavit of the said person who took the same, a copy of which census with the verification thereon is hereto attached marked Exhibit "B" and made a part hereof.

 

        Applicants allege that the aforesaid survey and map and the aforesaid census when the same was completed and verified as aforesaid and this petition left at the convenient place to-wit, at the United State Post Office in the Town of Bradley, Grady County, Oklahoma, being a place within said territory, for examination by those having an interest in such application, for a period of not less than thirty days.

 

        Applicants allege that the boundaries as disclosed by the surveyor's map and plat aforesaid and the quantity of land embraced according to the survey are as follows:

The East Half of the Northeast quarter (E½, NE¼) and the North Half of the Southeast Quarter (N½, SE¼) of Section 27, Township 5 North, Range 5 West, Grady County, State of Oklahoma, containing 160 acres, more or less.

 

        Applicants allege that the resident population of the above-described area according to the aforesaid census taken is 293 persons, and that there are in said area 137 qualified voters.

        Applicants allege that one of the applicants, A. T. Brown, left the above-mentioned survey, map, census and petition at the United State Post Office in the Town of Bradley within the above described territory, for examination by those having an interest in such application, on the 19th day of October, 1938, as more fully appears from the affidavit of A. T. Brown hereto attached marked Exhibit "C" and made a part hereof.

        Applicants allege that a proper notice of intention to present said survey, map, census and this petition to the Board of County Commissioners was duly posted in five public places on the 19th day of October, 1938, as more fully appears from the affidavit of A. T. Brown, one of the applicants herein, and a resident of said Town, attached to the original of said notice, which notice and the said affidavit are hereto attached marked Exhibit "D" and made a part hereof.

        Applicants allege that the survey, map, census and petition above-mentioned were continuously posted and held on exhibition at the United State Post Office in the Town of Bradley, Grady County, Oklahoma, subject at all times to examination by anyone interested, for a period of thirty days next preceding the 19th day of November, 1938, the day set out in the said notice of presenting this petition to this Honorable Board as more fully appears from the affidavit of A. T. Brown hereto attached and marked Exhibit "E" and made a part hereof; that the said affidavit was signed and attached hereto after the same was signed by the said A. T. Brown.

        Applicants allege that they have complied with all of the statutes of the State of Oklahoma in this case made and provided and have done or caused to be done all of the things requisite as required by the statutes of the State of Oklahoma, before presenting this their petition to this Honorable Board, for the incorporation of a of Oklahoma pertaining to the incorporation of towns have been fully complied with and that these applicants are entitled to the Honorable Board's order declaring that the territory herein described shall with the assent of the qualified voters thereof as provided by the statutes of the State of Oklahoma, be an incorporated town by the name of "Bradley," that the name of "Bradley" is different from that of every other town in this State, and that these applicants are entitled to the order of this Honorable Board including a notice for a meeting of the qualified voters resident in the said proposed town, at a convenient place therein to be by them named, on some day within one month therefrom, to determine whether such territory shall be an incorporated town; that this Honorable Board should cause ten days' notice of such meeting by publication in a newspaper published in the County and by posting up copies of said notice, not less than ten in number, at the most public places in said proposed incorporated town, and further order of the Honorable Board requiring a return of the election aforesaid to be filed with the County Clerk and which return should be signed by the elected inspectors at said election and further showing the number of votes cast for incorporations and the number of votes against incorporation.

 

        WHEREFORE applicants pray that the Honorable Board hear this application on the 19th day of November, 1938, or as soon thereafter as the Board can receive and consider the same, and that upon such hearing the Honorable Board make an order declaring the territory hereinabove described shall be with the assent of the qualified voters thereof as provided by the statutes of the State of Oklahoma, an incorporated town by the name of "Bradley" and that said name is different from that of every other town in this State, and that the Honorable Board also include in such order a notice for a meeting of the qualified voters resident in the said proposed town, at a convenient place named by them on some day within one month from the date of said order, to determine whether said territory hereinabove described shall be an incorporated town, and further order that the Honorable Board cause ten days' notice of said meeting, by publication in a newspaper published in the County, and by posting up copies of said notice, not less than ten in number, at the most public places in said proposed incorporated town, pursuant to the statutes of the State of Oklahoma in such case made and provided, and that the Honorable Board make further order that at the meeting of the qualified voters as aforesaid, polls shall be opened at the nine o'clock in the forenoon of such day and shall be kept open until four o'clock in the afternoon when said polls shall be closed, and further providing that the voters at such meeting shall first proceed to the election of three inspectors who after being duly chosen and qualified and one of their number elected clerk, shall without delay proclaim to the meeting that the poll is open and that they are ready to receive the ballots of the voters, and further ordering that the qualified voters of said proposed incorporated town shall vote by ballot having thereon the words "for incorporation, yes," or the words "for incorporation, no," and that if the majority of the ballots given at such meeting shall have thereon the word "no," the voters of such proposed town shall be deemed not to have assented to the incorporation thereof as a town, and no further precedings shall be had in relation thereto, but if a majority of such ballots shall have thereon the word "yes," such territory shall from that time be deemed an incorporated town, to have continuance thereafter by the name and style specified in said order of the Board of County Commissioners heretofore entered, and further ordering that the inspectors of such meeting and further showing the number having the word "yes" thereon, and the number having the word "no" thereon which statement shall be verified by the affidavit or such inspectors and shall be returned to the Board of County Commissioners at their next session, and your applicants will ever respectfully pray.

        A. C. Vaughan, of lawful age, being duly sworn, deposes and says that he is the Deputy County Surveyor of Grady County, Oklahoma, and is a practical surveyor and that he made the within and foregoing map of the territory intended to be embraced within the limits of the proposed incorporated town of Bradley and that the said map and plat above and marked Exhibit "A" was surveyed and platted by him and that he made the map and survey principally by tracing the maps and surveys made of said proposed town many years heretofore and which are on record in the office of the County Clerk of Grady County, Oklahoma, and that it appears from the records in the Clerk's office of Grady County, Oklahoma, that the original survey of the town was made by the United States Government prior to statehood and has been recorded in the office of the County Clerk ever since statehood and that Thacker's Addition to the Town of Bradley as shown on said map and plat was surveyed and dedicated prior to the time of the proposed incorporation which map and plat of said Addition has been for a number of years and is now on file in the office of the County Clerk of Grady County, Oklahoma.  That such survey, map and plat shows the courses and distances of the boundaries thereof and the quantity of land contained therein and that the said map, plat and survey is true, correct and accurate as the affiant verily believes.

Brown, of lawful age, being duly sworn, deposes and says that pursuant to Section 6616, O.S. 1931, he caused an accurate census to be taken of the resident population of the territory intended to be embraced within the limits of the proposed incorporated town of Bradley, Grady County, Oklahoma, which territory is shown by the survey and map verified by the affidavit of the surveyor and attached hereto and which map and plat is on file and of record in the office of the County Clerk of Grady County, Oklahoma, and embraces the following described lands situated in Grady County, State of Oklahoma, to-wit:

TO THE RESIDENTS OF THE TOWN OF BRADLEY:

 

        You and each of you will take notice that one-third of the whole number of qualified voters residing in the territory described in the map and plat of the Town of Bradley on exhibition at the United States Post Office of the Town of Bradley for examination by you and each of you, will present their petition to the Board of County Commissioners of Grady County, Oklahoma, on the 19th day of November, 1938, or as soon thereafter as the Board can receive and consider the same, for the incorporation of the said area described in said map and plat and survey aforesaid as the Town of Bradley, and that a survey, map and plat of the said area duly verified by a practical surveyor, and an accurate census of the resident population of said area duly verified by the census taken and the petition for incorporation are on exhibition for examination by those of you having an interest in said application, in the United States Post Office of the Town of Bradley, and will be on exhibit for a period of thirty days from the date hereof.

 

        That you and each of you may appear before the Board of County Commissioners on the day and date hereinabove set forth for the presentation of said petition for the incorporation of said town, and show cause if any you have why an order should not be entered by the Board of County Commissioners of Grady County, Oklahoma, declaring that said territory shall with the assent of the qualified voters thereof, be an incorporated town by the name of "Bradley" and for such further order in connection therewith as is provided by the statutes of the State of Oklahoma in such case made and provided.

ORDER FOR INCORPORATION OF THE TOWN OF BRADLEY

 

        Now on this 21st day of November, 1938, comes on for hearing before Edwin F. Campbell, Ben Goff, and T. F. Foster, the Board of County Commissioners of Grady County, Oklahoma, in regular session, the petition of more than one-third of the number of qualified voters resident in the Town of Bradley, for the incorporation of such Town of Bradley, and it appearing to the Board that said petition for incorporation was presented to this Board on the 19th day of November, 1938, by filing said petition with the County Clerk of Grady County, Oklahoma, the Clerk of the Board of County Commissioners, on said date as appears from the filing mark on said Petition, and it appearing that this the 21st day of November, 1938, is as soon thereafter as this Board could receive and consider the said Petition.

 

        And it further appearing that the applicants signing said Petition constitute more than one-third of the whole number of qualified voters residing in the area and territory hereinafter described.

 

        And it further appearing from affidavits and by oral examination of witnesses before the Board than the survey, map and census therein in the Petition alleged were prepared, made and taken as in the Petition set forth and that the same were subject to examination in the manner and for the period required by Section 6617, O.S. 1931, and it further appearing that a proper notice of intention to present said survey, map, census and said Petition to this Board was duly posted in five public places in the said area hereinafter described on the 19th day of October, 1938, as more fully appears from the affidavit of A. T. Brown, one of the applicants and a resident of said Town, which affidavit together with the original of said notice, is attached to the said petition.

 

        And it further appearing that the Board is satisfied that the requirements of Chapter 33, Article 25, O.S. 1931 relating to the incorporation of towns have been fully complied with.

 

        IT IS THEREFORE ORDERED, ADJUDGED, DECREED and DECLARED by the Board of County Commissioners of Grady County, Oklahoma, that the following described territory located in Grady County, State of Oklahoma, to-wit:

 

The East Half of the Northeast quarter (E½, NE¼) and the North Half of the Southeast Quarter (N½, SE¼) of Section 27, Township 5 North, Range 5 West, Grady County, State of Oklahoma, containing 160 acres, more or less,
shall with the assent of the qualified voters thereof as in this order provided, be an incorporated Town by the name of "Bradley," and that the name of "Bradley" is different from that of every other town in this State.

        It is further ordered that the following is a notice for a meeting of the qualified voters resident in said proposed Town of Bradley at a convenient place therein which has been named by them at this hearing, to determine whether the above described territory shall be an incorporated town to-wit:

THE BOARD OF COUNTY COMMISSIONERS OF GRADY COUNTY, STATE OF OKLAHOMA, TO THE QUALIFIED VOTERS RESIDENT IN THE PROPOSED TOWN OF BRADLEY:

 

        You and each of you are hereby notified that a meeting of the qualified voters resident in the proposed Town of Bradley will be held at the Schoolhouse in the Town of Bradley, Oklahoma, on the 5th day of December, 1938, to determine whether the following described territory situated in Grady County, State of Oklahoma, to-wit:

 

The East Half of the Northeast quarter (E½, NE¼) and the North Half of the Southeast Quarter (N½, SE¼) of Section 27, Township 5 North, Range 5 West, Grady County, State of Oklahoma, containing 160 acres, more or less,

 

shall be an incorporated Town.

        It is further ordered that this Board shall cause ten days' notice of such meeting set forth in the above Notice to be given by publication in the Chickasha Daily Express, a newspaper published in the County, and by posting up copies of said Notice, not less than ten in number, at the most public places in said proposed incorporated Town.

 

        It is further ordered that at the meeting of the qualified voters in this order provided, the polls shall be opened at nine o'clock in the forenoon on the day set forth in such Notice and shall be kept open until four o'clock in the afternoon of said day when they shall be closed.

 

        It is further ordered that the voters at such meeting shall first proceed to the election of three inspectors who after being duly chosen and qualified and one of their number elected Clerk, shall without delay proclaim to the meeting that the poll is now open and that they are ready to receive the ballots of the voters.

 

It is further ordered that the qualified voters of said proposed incorporated Town of Bradley shall vote by ballot having thereon the words "for incorporation, yes," or the words "for incorporation, no," and if a majority of the ballots given at such meeting shall have thereon the word "no," the voters of such proposed town shall be deemed not to have assented to the incorporation thereof as a town, and no further proceedings shall be had in relation thereto.  It is further ordered that if a majority of such ballots shall have thereon the word "yes," such territory shall be deemed an incorporated town, to have continuance thereafter by the name and style of "Bradley", and the inspectors of such meeting shall make a statement showing the whole number of ballots given at such meeting and showing the number having the words "yes," thereon and the number having the words "no," thereon, which statement shall be verified by the affidavit of such inspectors and shall be returned to the Board of County Commissioners of Grady County, Oklahoma at their next session.

        You and each of you are hereby notified that a meeting of the qualified voters resident in the proposed Town of Bradley will be held at the Schoolhouse in the Town of Bradley, Oklahoma, on the 5th day of December, 1938, to determine whether the following described territory situated in Grady County, State of Oklahoma, to-wit:

STATEMENT OF ELECTION

 

        R. B. Marshall, A. A. Perry, and George T. Martin, pursuant to the order of the Honorable Board of County Commissioners of Grady County dated November 21, 1938, in the matter of the incorporation of the Town of Bradley, hereby make this their statement and return of the election in the said order required and report to the Honorable Board:

 

        That pursuant to the Notice of the meeting of the qualified voters of Bradley which notice was duly published in a newspaper in Grady County, Oklahoma, more than ten days prior to said meeting and posted in not less than ten of the most public places in the said proposed incorporated Town of Bradley as more fully appears from the Notice together with the affidavit of publication and affidavit of posting thereto attached and on file before this Honorable Board, the voters of the proposed incorporated Town of Bradley met December 5, 1938, and proceeded to the election of three inspectors, and the undersigned were duly chosen and qualified as such, as appears from the Oath of Office of each of the undersigned hereto attached and marked Exhibits "A-1", "A-2", and "A-3", and that immediately the undersigned proceeded to elect George T. Martin, one of their number, Clerk, and did without delay proclaim to the meeting that the poll was open and that the undersigned were ready to receive the ballots of the voters.

 

        That the polls opened at nine o'clock in the forenoon of said day and were kept open until four o'clock in the afternoon when they were closed.

 

        The qualified voters of said proposed incorporated town voted by ballot having thereon the words "for incorporation, yes," or the words "for incorporation, no," and a majority of such ballots had thereon the words, "yes."

 

        That the whole number of ballots given at such meeting were as follows:

 

            1.  The number having the word "Yes," thereon: 69

 

            2.  The number having the word "No," thereon: None

 

            Total ballots: 69

 

        WHEREFORE the undersigned having made their full return as by the order of this Honorable Board required and by the statutes in such case made and provided, pray that the Honorable Board find that they are satisfied of the legality of said election and make their order in the premises.

        Now on this 3rd day of January, 1939, pursuant to the order of the Board of County Commissioners of Grady County, Oklahoma, dated November 21, 1938, in the matter of the incorporation of the Town of Bradley, R. B. Marshall, A. A. Perry and George T. Martin having made a statement verified by their affidavit, and returned to the Board of County Commissioners of Grady County at their next session after the time set forth in said order.

 

        And it appearing to the Board that pursuant to the order entered herein on November 21, 1938, that the notice set forth in said order was given by publication in the Chickasha Daily Express, a newspaper published in the County, and by posting up copies of said notice, not less than ten in number, at the most public places in said proposed incorporated town, at least ten days before the meeting set forth in said notice as more fully appears from the publisher's proof of publication and affidavit of posting returned and on file in this matter.

 

        And it further appearing that the voters of the proposed incorporated Town of Bradley met, pursuant to said notice, on December 5, 1938, and proceeded to the election of three inspectors as provided in said order and that R. B. Marshall, A. A. Perry and George T. Martin aforesaid were duly chosen and qualified as such inspectors and that each of said inspectors on file herein.

 

        And it further appearing that immediately upon the election and qualification of said inspectors, that George T. Martin, one of their number, was elected by them as Clerk and that they did without further delay proclaim to the meeting that the poll was open and that the inspectors were ready to receive the ballots of the voters.

 

        And it further appearing that the polls opened at nine o'clock in the forenoon on December 5, 1938, and were kept open until four o'clock in the afternoon when they were closed, and that the qualified voters of said proposed incorporated town voted by ballot having thereon the words "for incorporation, yes," or the words "for incorporation, no," and that a majority of said ballots had thereon the word, "yes."

 

        That the whole number of ballots given at such meeting were as follows:

            2.  The number having the word "No," thereon: None

 

            Total ballots: 69

       

        And it further appearing to the Board of County Commissioners that the said order of the Board and the statutes in such case made and provided have been compiled with in all things and the Board being satisfied of the legality of such election.

 

        It is therefore ORDERED by the Board of County Commissioners of Grady County, Oklahoma, and declared that the said Town has been incorporated by the name of "Bradley."
